Curatorship & Administratorship
High Court curatorship and Mental Health Care Act administrator support for families protecting vulnerable loved ones, their dignity and their assets.
Curatorship in South Africa
When a loved one loses the mental capacity to manage their own affairs due to dementia, traumatic brain injury, mental illness or severe disability, families can be left between two unsafe choices: watch assets dwindle, or act without clear legal authority.
Curatorship is the South African legal mechanism that allows the High Court to place a person's welfare, assets or both under the control of a trusted and accountable curator. Inheritance Legacy Holdings guides families through the sensitive process of deciding whether curatorship, administratorship or another lawful route is appropriate.
What Curatorship Means
Represents the person in a specific legal proceeding, usually during the curatorship application or another matter where they cannot properly instruct attorneys.
Makes personal, healthcare, residence and daily welfare decisions for a person who is mentally or physically incapacitated. This role focuses on dignity and quality of life rather than asset management.
Manages financial assets, property, investments, debts and related administration where the person cannot sign documents or manage money safely.
Combines financial and personal authority where both forms of protection are required, subject to the terms of the court order.
Legal Foundation
Curatorship is grounded in South African common law, the High Court's protective jurisdiction and Rule 57 of the Uniform Rules of Court. The Mental Health Care Act, 2002 also provides a separate administrative route for the appointment of an administrator in appropriate mental-health-related property matters.
A curator remains accountable to the Master of the High Court through security, inventories, accounts and ongoing oversight. That accountability is what gives families, banks, care providers and beneficiaries a legally recognised decision-maker.
Appointment Requirements
Medical evidence must show that the person is incapable of managing their own affairs. General age, frailty or family disagreement is not enough.
The application must show that assets, contracts, care decisions or welfare needs require legal protection and cannot safely be managed informally.
The proposed curator must be fit and proper, free of conflicts, financially reliable and able to provide any security required by the Master.
Why Curatorship Matters
Professional Support
A professional curator has no inheritance interest, which helps reduce conflict where siblings or relatives disagree about money.
Annual accounts, asset schedules and inventories must be prepared correctly for the Master of the High Court.
Security may be required to protect the estate against theft or negligence. Professional administrators can help arrange this efficiently.
Financial decisions can be separated from caregiving relationships, allowing family members to focus on the person rather than the paperwork.
Do Not Act Without Appointment
Mental Health Care Act Route
In some mental-health-related property matters, the Master of the High Court can appoint an administrator under the Mental Health Care Act without a full High Court curatorship application. This route is generally used for smaller, less complex estates where the person has been diagnosed with a mental illness or severe or profound intellectual disability and cannot manage their property.
A medical or mental health care practitioner must support the conclusion that the person cannot manage their own property.
The Master considers the prescribed property value and annual income thresholds before deciding whether the administrative route is suitable.
A written application with the required supporting information is submitted to the Master in the relevant jurisdiction.
The administrator remains under the Master's control and may need to lodge security and account for the administration.
